Note on DCR for MADURAI

Government have approved uniform guidelines or Development Control Regulations relating to Special Buildings, Multi-Storeyed Buildings, Group Developments, layouts and sub-divisions.

Regulations include provisions for areas where Multi-storeyed Buildings are permissible. It is expected that the comprehensive guidelines will avoid different technical interpretations at various level and will be of great help to common public and also for the officials to follow uniform guidelines and ensure expeditious issuance of planning permission.

To eliminate difficulty where demonstrable hardships is caused, Government have constituted a empowered committee consisting of Secretary, Housing and Urban Development Department as chairman, Secretary, MAWS Department and Member-Secretary, Chennai Metropolitan Development Authority as Members and Director of Town and Country Planning as Convener of the Committee to look into the cases and relax the planning parameters.

These DCR parameters takes effect from 14.6.2010 and all the building appeal applications received earlier to 14.06.2010 will be disposed with reference to then existing regulations and related parameters

The scheme parameters

• Any deviation to the sanctioned master plan / detailed development plan will be construed as unauthorized development and liable for demolition.

• The Government has power to vary the classification of land.
• Detailed Development Plan also stipulates schemes clauses for development. The important parameters are:-
  • Minimum extent : 220 sq.m
  • Minimum width of site : 12m
  • Building line : Depending upon road width
  • Side and rear open : 1.5 m and 3m
  • Plot coverage : 50%

LAYOUT PLAN

The minimum requirement for a layout approval :-
• The land must conform with the land use contemplated in the development plans.
• The land must be owned by the applicant and free from encumbrances.
• The land should gain access from the public road having a width of not less than 30 feet.
• The land should be free from land acquisitions, urban ceiling, etc.

• In all layouts of extent 2500 sq.mts and above, 10% of the area shall be reserved for park or children play spaces besides 1% area for local shops.
  
  • The park and road reservation spaces should be handed over to the concerned local body.

BUILDING REGULATIONS

• Certain minimum standards for life safety, health, public welfare and protection of property

• Regulating and controlling of design, construction, use and quality of materials, occupancy, location and type of buildings.

The scrutiny of the building plans may be with reference to the following and as specific to the area and site.
• The building byelaws framed for the cities, Towns and rural areas based on the National Building Code.
• Madras City Corporations Act 1919 and the building rules made there under.
• Tamil Nadu District Municipalities Act 1920 and the building rules framed under.
• Tamil Nadu District Municipalities Building Rules 1972.
• Special rules regulating the construction and maintenance in the vicinity of civil Aerodrome 1970.
• Tamil Nadu Nuclear Installations (Regulations of Building and use of land) Rules 1990.
• Tamil Nadu District Municipalities (Hill Stations) Building Rules 1993.
• Tamil Nadu Panchayat Act and rules made under.
• Tamil Nadu Panchayat Building rules 1997.

• Multistoryed building includes all buildings with more than four floors (including ground floor) or whose height is more than 15 m.

• Buildings other than Multistoreyed and ordinary buildings have been classified as special buildings.

• Special building means a residential or commercial building with more than two floors and not exceeding 4 floors inclusive of ground floor.

• - Front set back depending upon the road width

• Commercial building
- FSI: 1.5

GROUP DEVELOPMENT

Group development means accommodation for residential or commercial or combination of such activities housed in two or more blocks of buildings is a particulars site irrespective of whether these structures are interconnected or not.

Any interlink between two structures in terms of connecting corridors shall not be constructed as making any two structures into one block.

However if these blocks are connected solid by at least for 1/3 rd of width of any one block on the connecting side, than such block shall be constructed as a single block.

• Access way 7.2 m
• Block to block set back 6m
• Block to boundary of the site 6m
• FSI 1.5
• P.C 50 to 70%
• Open space 10%
• Parking as per standard.
